These Terms and Conditions (“Terms”) set out the basis on which you may access and use the ITS STYLED website, mobile applications, and related services (collectively, the “Platform”). By using the Platform, you agree to comply with and be bound by these Terms. Please read them carefully.

ITS STYLED LLC (“we”, “us”, “our”) is a company registered in Florida, USA, with its registered office at 2125 Biscayne Blvd, Ste 204 #20613, Miami, FL 33137. If you do not agree with these Terms, you must not use the Platform.

We wish to draw your attention to our policies relating to the terms of purchase within the TOS and our Privacy Policy. We reserve the right to only accept orders from those over 18.

We may modify the TOS from time to time. Please read the TOS and check back often. If you do not agree to any change to the TOS then you must immediately stop using the Site. Any changes made after you have placed an order will not affect that order unless we are required to make the change by law.

Registration and account Terms and Conditions

To use certain features of the ITS STYLED Platform — such as creating and saving looks, accessing your Wish List, or enjoying advanced membership benefits — you will need to register for an account. When you register, you must provide accurate and complete information. Please notify us promptly if your details change by contacting us at support@itsstyled.com.

By creating an account, you will be able to:

• Save and organize your favorite looks in one place.

• Build a personalized Wish List of items you like from our partners’ stores.

• Use the LookFrame to create custom outfits and try them on your LookMate.

• Access additional styling features depending on your membership plan.

• Manage your account details, preferences, and communication settings.

Please note that ITS STYLED does not sell or ship products directly. Purchases of items displayed on our Platform are processed through third-party partner websites, and their own terms and conditions will apply.

To create an account, simply click on SIGN UP or REGISTER NOW to fill in your details. The account password you create should be unique and kept secure, and you must notify ITS STYLED immediately of any breach of security or unauthorized use of your account.

Should you have any issues with your account or need any help in relation to it, then please do not hesitate to contact our Customer Care team. However, please note that we can only communicate with the named account holder in relation to any questions, changes or cancellation of an account.

Forgotten password

If you have forgotten your password, follow the FORGOTTEN PASSWORD instructions on the SIGN IN page. For security reasons we are unable to send your password via email.

Eligibility to purchase

Use of the ITS STYLED Platform is limited to individuals who can lawfully enter into and form contracts under the laws of their country of residence. By registering for an account or using our services, you confirm that you are at least 18 years old (or the minimum legal age required in your jurisdiction) and that all information you provide is true, accurate, and complete.

ITS STYLED does not sell or ship merchandise directly. Any purchase of items shown on our Platform is completed through third-party partner websites. When you click to purchase, you will be redirected to the relevant partner’s site, and your order will be subject to that partner’s terms and conditions, privacy policy, and applicable laws.

By using the ITS STYLED Platform, you agree that we are not a party to your purchase contract with third-party retailers, and we are not responsible for payments, shipping, returns, or refunds related to such transactions.

Furthermore, you agree that when you make a purchase through a third-party partner site, your personal information may be processed by that partner for purposes such as payment verification, fraud prevention, and compliance with applicable laws. ITS STYLED does not process or store your payment details.

Orders

ITS STYLED does not sell or ship products directly. All items shown on our platform are linked to third-party partner stores. When you select an item and choose to purchase it, you will be redirected to the partner’s website to complete your order.

Please note that the final purchase price, including any applicable sales taxes, import duties, shipping costs, promotional discounts, or exchange rates — will always be determined by the retailer on their own website at the time of checkout.

Because pricing and availability are controlled by third-party retailers, prices shown on ITS STYLED may change at any time without prior notice. We cannot guarantee accuracy, availability, or that an item displayed on our platform will remain at the same price when you proceed to purchase.

All payments, invoices, applicable taxes, duties, and shipping fees are handled directly by the retailer you select. ITS STYLED does not process payments, issue invoices, or apply local tax rules. Additionally, we are not responsible for any currency exchange charges or international transaction fees applied by your bank or payment provider.

Membership Pricing

In addition to product browsing, ITS STYLED offers membership plans that provide access to premium features on our platform. Membership prices are also set in US Dollars (USD) and will be clearly displayed at the time of purchase. Taxes may apply depending on your billing location. Subscriptions are billed through ITS STYLED directly and are subject to the Membership Terms & Conditions.

Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, images, audio clips, videos, digital downloads, data compilations, and software, is the property of ITS STYLED LLC or its content suppliers and is protected by intellectual property laws of the United States and international treaties.

You may not copy, reproduce, distribute, display, sell, license, or otherwise exploit any content on the Platform without our prior written consent. Any unauthorized use of the Platform’s content may violate copyright, trademark, and other laws and may result in legal action.

You retain ownership of the content you upload to the Platform, but by uploading, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute such content solely for the purpose of operating, promoting, and improving the Platform.

We respect the intellectual property rights of others and expect users to do the same. If you believe that your intellectual property rights have been infringed, please contact us.

Platform Use and Restrictions

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not:

• Use the Platform in any way that violates applicable laws or regulations.

• Attempt to interfere with, damage, or disrupt any part of the Platform or its security features.

• Use any automated means (including bots, scrapers, or crawlers) to access or collect data from the Platform without our express permission.

• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

• Upload or share any content that is unlawful, offensive, defamatory, obscene, abusive, or otherwise inappropriate, as determined by us at our sole discretion.

We reserve the right to remove any content or suspend/terminate access to the Platform at any time, with or without notice, and without providing a reason.

Prohibited Conduct

You agree not to use the Platform for any unlawful, harmful, or abusive purpose. This includes but is not limited to:

• violating any applicable laws or regulations

• infringing the rights of others, including intellectual property or privacy rights

• uploading or sharing content that is offensive, defamatory, obscene, or discriminatory

• engaging in harassment, threats, or abusive behavior toward any user or staff

• attempting to access accounts or data that do not belong to you

• interfering with the normal operation, security, or integrity of the Platform

• using bots, crawlers, or automated systems to access or misuse the Platform

We reserve the right to investigate and take appropriate action, including suspending or terminating access, for any violation of these rules.

Disclaimers

The Platform is provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not guarantee uninterrupted or error-free operation, that defects will be corrected, or that the Platform or the servers that make it available are free of viruses or harmful components.

We make no representations or warranties regarding the accuracy, reliability, or completeness of any content or services provided through the Platform. Your use of the Platform is at your own risk.

Limitation of Liability

We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

We do not guarantee uninterrupted or error-free operation of the Platform, and we make no warranties of any kind. Use of the Platform is at your own risk.

Indemnification

You agree to indemnify, defend, and hold harmless ITS STYLED LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with:

• your access to or use of the Platform

• your violation of these Terms

• your violation of any third-party rights, including intellectual property or privacy rights

• your content or actions that cause harm to us or others

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defenses.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. By using the Platform, you agree that any disputes or claims arising out of or relating to these Terms shall be exclusively resolved in the state or federal courts located in the State of Florida.

Termination

We may suspend or terminate your access to the Platform at any time, without prior notice, if we believe you have violated these Terms or engaged in unlawful or inappropriate use of the Platform.

You may also terminate your account at any time by following the instructions in your account settings.

Upon termination, your right to access and use the Platform will immediately cease, and we may delete or deactivate your account and associated content.

Payments and Third-Party Services

All payments on our Platform are processed through third-party providers, including Stripe, Inc. (“Stripe”). By making a purchase or engaging in any transaction, you agree to be bound by Stripe’s Terms of Service and Privacy Policy, which govern the handling of your payment information.

We do not store or process payment card details ourselves. Any issues related to payments, including billing disputes, chargebacks, or fraud investigations, are subject to Stripe’s processes and policies.

You acknowledge that ITS STYLED LLC is not liable for any errors, delays, or damages arising from the use of third-party payment providers.

Subscriptions

We offer optional subscription plans that provide enhanced access to features such as unlimited AI tools, premium capsule generation, advanced customization, and other exclusive content. By subscribing, you authorize us to charge your payment method on a recurring basis (monthly or annually, depending on your chosen plan) until you cancel.

You can cancel your subscription at any time through your account settings. Your access to subscription features will remain active until the end of your current billing cycle. We do not provide partial refunds for unused time.

We reserve the right to modify, suspend, or discontinue any subscription plans or features at any time. If changes affect existing subscribers, we will provide advance notice via email or through the Platform.

Discounts, trial periods, or promotional offers may be available occasionally. These are subject to specific terms and may be revoked if abused.

Shipping & Delivery

ITS STYLED does not ship or fulfill orders directly. All products featured on the Platform are sold and delivered by third-party partner stores.

Delivery terms, shipping times, fees, and available destinations are determined by the respective partner from which you place your order. By purchasing a product through our Platform, you agree to be bound by that partner’s shipping and delivery policies.

We are not responsible for delays, lost shipments, customs issues, or delivery errors. All delivery-related inquiries must be directed to the relevant seller or merchant.

Dispute Resolution and Arbitration

Any disputes or claims arising out of or in connection with your use of the Platform, including these Terms, shall be resolved through final and binding arbitration conducted under the rules of the American Arbitration Association (AAA). By using the Platform, you agree to waive your right to bring or participate in any class action, class arbitration, or other representative action.

Arbitration shall take place in a mutually agreed location or virtually, and the decision of the arbitrator shall be final and enforceable in any court of competent jurisdiction.

Mobile App

We may offer a mobile application that provides functionality substantially similar to the web Platform, including creating and saving looks, trying items on a mannequin, liking and sharing content, and accessing Membership features. Product purchases initiated in the app are completed on third-party partner websites and are governed by those partners’ terms and policies. App features may vary by device and region and may be updated from time to time.

AI-Generated Content Disclaimer

Some content presented on the Platform, including but not limited to styling suggestions, outfits, and visual images, may be generated using artificial intelligence tools. Such content is provided solely for inspirational and illustrative purposes.

We do not guarantee that AI-generated content will meet your expectations, represent real-world accuracy, or reflect professional styling advice. Your use of such content is entirely at your own discretion and risk.

ITS STYLED is committed to making its Platform accessible to all users, including individuals with disabilities. We strive to comply with all applicable digital accessibility standards and to continuously improve user experience and inclusivity.

We reserve the right to suspend, restrict, or permanently terminate your access to the Platform if, in our reasonable judgment, you violate these Terms, engage in fraudulent, abusive, or harmful behavior, or otherwise misuse the services offered. Refunds & Returns

ITS STYLED assumes no responsibility for the processing of returns, exchanges, cancellations, or refunds related to items purchased from third-party vendors.

Taxes
